The Shenzhen shuffle is the process in which a visitor to Hong Kong takes a short trip out of the country to somewhere close, for example Shenzhen or Macau, when their current visa is reaching its end date to refresh it. This allows their visa to be extended for another period of time, depending on their nationality, it could be up to 90 days to allow you to stay as a visitor. However this is a very risky way to extend your visa because at the border, it’s the immigration officer’s job to make sure you’re are a legitimate visitor, and if they believe you aren’t, they can deny you entry or give you a small amount of time, maybe a week, to sort your affairs and leave the country. The more times you use this process, the more likely you are to be denied entry. The amount of times you use this method shouldn’t exceed five times, however the immigration officer might question you even on your third or fourth time, therefore this is not a recommend technique to extend your visa.

If you decide for this option of updating your tourist visa, you must remember to obtain a China visa beforehand, as you do need to go out of Hong Kong before entering again, otherwise you won’t be able to update your visa.

Employment visa

Recent changes to the Hong Kong Immigration system now makes it slightly harder for an individual to obtain an employment visa, with the guidelines becoming stricter. An applicant must first have a job offer from a company in Hong Kong, ideally before the applicant has moved to HK. Although this is not always practical, the immigration service say you should not move to HK before obtaining your visa, but they know that sometimes isn’t practical, and may need to be in HK to search for a job. In general application can take between 7 and 8 weeks, but can take a lot longer.

 

The application guidelines that need to be adhered to are as follows:

  • An applicant must have a graduate degree, with at least 5 years technical experience in the position they will be working.
  • If an applicant doesn’t have a degree, they must have at least 10 years technical experience in the position they will be working.
  • The salary of the job you’re applying for must meet the local professional standard, which must be higher than HK$16,000 a month.
  • The company you’re planning to be working for needs to prove that you’re special skills will be required, and the position can’t be filled by someone local.
  • That the business you will be working for is sustainable and that the company is more than 12 months old
  • That you as an individual will contribute to the local economy.

All of the guidelines above will need to be satisfied for an applicant to pass the approvability test, which allows for a successful application.

学生签证

要获得学生签证,申请人必须注册在香港学院注册的全日制课程,持有录取通知书,需要当地赞助商(由大学安排)的签名文件,身份证复印件和/或旅行证件,并能够支付课程费用、生活费和住宿费。申请人必须能够在不工作且无需使用公共资金的情况下支付这些费用。在收到所有所需文件后,通常需要六周时间来处理签证或入境许可申请。香港的大学学费介于 150,000 至 200,000 港元之间。如果申请被接受,申请人将获得与课程长度相同的签证。课程完成后,如申请人决定留在香港,他们可以申请非本地毕业生移民安排 (IANG) 签证,将他们的学生签证再转换 12 个月,无需任何问题,无需雇主。但是,如果申请人决定要在香港逗留更长时间,并且是在12个月的延期内找到工作,薪水按当前市场水平计算,他们的签证可以再续签2年。

投资签证

投资签证适用于任何希望通过在香港开展业务而留在香港进行投资的企业家。符合以下条件的申请将被优先考虑:
没有安全异议,包括没有严重犯罪记录,
具有良好的教育背景,例如相关背景的第一学位(有时接受良好的技术资格或证明的能力),
申请人必须能够为香港特别行政区的经济作出重大贡献,并考虑(不限于)商业计划、营业额、财务资源、投资金额、在本地创造的就业岗位数量以及引进新技术或技能。
商业计划
有意在香港设立或加入业务的申请人,须提交一份为期两年的商业计划书,说明业务性质、市场分析、市场定位、业务方向、销售目标、产品营销策略等,以证明该业务适合并有能力在香港发展。申请人还应提交两年期损益表、现金流量表和资产负债表的预测,以证明业务在运营、财务和发展方面的可行性。
如有需要,入境事务处会就申请人的商业计划征询有关政府部门或专业团体的意见,以评估该业务是否支持香港整体经济发展。例如,入境事务处可能会考虑申请人的业务是否属于或能够补充香港具有明显优势的行业,例如四大传统支柱产业(即贸易和物流、旅游、金融服务等、以及专业和生产性服务业)或经济发展委员会正在探索支持措施的四个产业集群(即交通运输、会展业和旅游业、制造业、创新技术和文化创意产业以及专业服务业)等。
营业额
如申请人在海外经营相关业务或已在香港参加业务,则须提交载有上年度营业额及利润的损益表及资产负债表。拟在香港设立业务者应提交上述两年期损益表及资产负债表预测,包括预期营业额,以证明业务营运及发展的可行性。
入境事务处在审核来港投资设立业务的申请时,亦会考虑申请人是否在有关业务方面有相关投资或工作经验。如有需要,入境事务处会征询有关政府部门或专业团体的意见,以评估该业务是否适合和能够在香港稳定增长,并为相关行业提供动力。
财政资源
申请人应提交上一年的个人和公司银行账户报表和其他资金来源证明,以及公司最近的经审计的财务报告(如有),以证明他/她有足够的财务资源在香港经营相关业务,并支持业务的顺利运营和可持续增长。
投资金额
申请人须提交证明在香港的资本投资金额的证明文件。入境事务处会考虑投资金额是否能够支持业务的运作。
本地创造的就业岗位数量
申请人应根据业务的性质和规模,列出其业务的组织结构以及所需的人员和职位数量。还应该说明在当地创造的实际工作岗位的数量和级别(例如经理、行政人员、专业人员、文书支持人员等)。
引进新技术或技能(如适用)
申请人须说明引进的新技术或技能如何激发香港高增值产业的创意,以及是否已取得专利,为香港的长远发展作出贡献知识经济

Cyberport Incubation Programme

An extremely useful government-backed programme is available that is looked on favourably by the Immigration Department is the Cyberport Incubation Programme. This scheme offers a whole range of benefits to make achieving your Investment Visa as easy as possible. Cyberport is managed by Hong Kong Cyberport Management Company Limited which is wholly owned by the Hong Kong SAR government. Cyberport assists and strengthens Information and Communications Technology (ICT) entrepreneurs and start-ups by offering financial assistance, support and professional services of all kinds in different stages of enterprise development. The incubation programme provides a wide range of support, including financial assistance of up to HK$530,000, a rent free office space for 24 months, state-of-the-art ICT facilities, and marketing and promotion opportunities such as up to HK$50,000 subsidies on marketing. There are certain eligibility criteria to be accepted onto the start-up programme, including the Incubatee must be a company registered and incorporated in Hong Kong upon admission, the applicant must have a viable business plan for a product or service to be ready for marketing in 12 to 18 months, projects must be rooted in ICT-related areas, the company must have sufficient funds, or plans to raise sufficient funds, for the company to operate for at least one year upon admission to the Incubation Programme, and that projects must have not received and will not receive funding granted by other publicly funded organisations/programmes. Applications to the Cyberport Incubation Programme are accepted all year round, however they are processed in batches. There are no fees involved in the whole application process. The application process for the programme is simple. The applicant must complete an online application form and also submit one set of signed hardcopy within three working days of submitting the online application.
