Chargeable Stamped Tenancy

Tenancy, Lease, Agreement for Rental and any other document of similar effect. Including their duplicate and counterpart are Tenancy Agreement. The Stamped Tenancy Agreement are chargeable via stamp duty. The landlord, tenant and any other persons signing the tenancy agreement are liable for payment of stamp duty. A legal Tenancy Agreement have to stamp within 30 days from the date of execution.

How to apply for a Stamp Tenancy Agreement

1/ Via the internet

The most convenient way is to submit a stamping application via the internet at the GOVHK.

2/ By Post

You can submit a stamping request in paper form [IRSD111(E)] by post. Also, you can attach a payment cheque to the application form. The cheque should payable to “The Government of the HKSAR” and cross.

3/ In person at the Stamp Office

You can visit the Stamp Office and present the original tenancy agreement for stamping over the counters. Please note that during the pandemic, the service hours may be varied.

ANTI-EPIDEMIC SOCIAL DISTANCING MEASURES TIGHTENED in HONG KONG

New Anti Epidemic Measures to tackle the Omicron-Variant Outbreak

Chief Executive Mrs. Lam announced that the Government will further tighten the social distancing measures. In the view of the COVID-19 epidemic situation. The anti-epidemic measures including prohibiting more than two households from gathering in private premises.

The Prevention & Control of Disease Regulation

The new rules will be under the Prevention & Control of Disease Regulation. The maximum number of people permitted for group gatherings in public places are 2 people. Additionally, the fixed penalty for any person who fails to comply with the compulsory testing requirement will be doubled. That is, from HKD5000 to HKD10000.

The Expansion of the scope of scheduled premises

Currently, there are 17 categories of scheduled premises under Cap 599F of the Prevention & Control of Disease (Requirements & Directions) (Business & Premises) Regulation. Also, the places of worship and hair salons have to close from 10th to 24th February, 2022. Furthermore, starting from 24th February, 2022, the scheduled premises is expanding to following:

  1. Places of worship
  2. Shopping Malls
  3. Department Stores
  4. Supermarkets
  5. Wet Markets
  6. Hair Salons

Anti-Epidemic measures from 24th February, 2022?

From February 24, people entering all scheduled premises, including the six new categories. They have to adhere to the vaccine pass arrangements by using the LeaveHomeSafe mobile app and presenting their vaccination record. Furthermore, the vaccine pass arrangement will also be applied in schools, universities, government-subsidised premises and offices in the public sector.

THE PROPOSAL OF 6TH ROUND OF ANTI-EPIDEMIC FUND

The Government is seeking the Legislative Council Finance Committee’s approve for injecting $27 billion into the 6th Anti-Epidemic Fund (AFE). The committee will discuss the funding proposal on 15th February, 2022.

Reasons for the proposal of the 6th round of the AEF

The Government fully understands the impact the pandemic and tightening of social distancing measures have brought to the community. So, the government has swiftly rolled out the 6th round of the AEF. Furthermore, the 6th round of the AEF aims to safeguard jobs and preserve the economic strength of Hong Kong. Then, Hong Kong will be able to recover as soon as possible when the omicron wave of the pandemic subsides.

What is new?

  • Over 60% of the total financial commitment is aiding individual.
  • The 6th round of the AEF introduces a Temporary Unemployment Relief.

What is the temporary unemployment relief?

The Temporary Unemployment Relief will provide a one-off, flat-rate $10,000-subsidy. No matter the employment is full-time or part-time and receiving a monthly salary not exceeding $30,000 before laid off. The workers have lost their jobs since the fifth wave of the pandemic started and have remained unemployed for at least one month at the time of application may enrol.

Who is eligible for the Temporary Unemployment Relief?

  • All kinds of employment: Full time, part time or self-employed;
  • Remain Unemployed for at least 1 months since January 2022;
  • Not the recipients of the Comprehensive Social Security Assistance or other measure under the 6th round AEF.

Still, this is the proposal and subject to final approval from the Legislative Council.

应对欧米克隆变种疫情的新防疫措施
行政长官林郑月娥宣布政府将进一步收紧社交距离措施。鉴于新冠肺炎疫情形势。禁止两户以上家庭在私人场所聚集等防疫措施。
疾病预防控制条例
新规定将在《疾病预防控制条例》下执行。在公共场所集体集会的人数上限为2人。此外，对任何不符合强制检测要求的人的定额罚款将增加一倍。即从5000港币到10000港币。
扩大预定经营范围
根据《预防及控制疾病(规定及指示)(业务及处所)规例》(第599F章)，现时有17类附表处所。此外，从2022年2月10日至24日，礼拜场所和美发沙龙将关闭。此外，从2022年2月24日起，预定场地将扩大到以下:
宗教活动场所的
购物中心
百货商店
超市
菜市场
美发沙龙
2022年2月24日起采取防疫措施?
从2月24日起，人们进入所有预定场所，包括六个新的类别。他们必须使用LeaveHomeSafe移动应用程序，并出示自己的接种记录，以遵守疫苗通行证安排。此外，疫苗通行证的安排亦会适用于学校、大学、政府资助单位和公营机构的办公室。

第六轮防疫基金提案

提出第6轮AEF的理由

总财务承诺的60%以上用于资助个人。
第6轮失业救济计划引入了临时失业救济。
什么是临时失业救济?
临时失业救济计划将提供一次性、固定费率的1万美元补贴。无论该雇员是全职或兼职，并在被解雇前月薪不超过30,000元。自第五波大流行开始以来，这些工人已经失去了工作，并且在申请登记时已经失业至少一个月。

谁有资格领取临时失业救济?
各种职业:全职、兼职或自雇;
自2022年1月起失业1个月以上;
不是第六轮综援计划下的综合社会保障援助或其他措施的受助人。
不过，这只是建议，还有待立法会的最终批准。

EXEMPTION FROM COMPULSORY HOTEL QUARANTINE WHEN GOING INTO CHINA

Nowadays, compulsory quarantine at hotel seems to be a protocol when travelling. However, if you are under certain category and fulfilling certain criteria. Then you may exempt from compulsory hotel quarantine when heading back to Hong Kong.

Who can be exempted?

Under section 4(1) of the Compulsory Quarantine of Persons Arriving at Hong Kong from Foreign Places Regulation (Cap. 599E) (the Regulation), made under the Prevention and Control of Disease Ordinance (Cap. 599), the Chief Secretary for Administration may designate any person or category of persons fulfilling certain criteria for exemption that –

  1. the person’s or persons’ entry into Hong Kong is necessary for –
    1. The supply of goods or services required for the normal operation of Hong Kong or the daily needs of the people of Hong Kong;
    2. Governmental operation;
    3. The protection of the safety or health of the people of Hong Kong or the handling of the public health emergency within the meaning of section 8(5) of the Ordinance concerning the specified disease;
    4. Or, because of the exceptional circumstances of the case, otherwise serves the public interest of Hong Kong; or
  2. the person’s or persons’ travelling is necessary for purposes relating to manufacturing operations, business activities or the provision of professional services in the interest of Hong Kong’s economic development.

Which categories can be exempted?

In accordance with section 4(1) of the Regulation, the Chief Secretary for Administration has exempted the following categories of persons from the compulsory quarantine requirement. For the latest arrangement of respective exemption categories, please approach the supporting policy bureau or departments direct for details.

  1. Crew members of aircraft who need to commute to and from foreign places for performance of necessary duties.
  2. Crew members of
    1. Goods vessels with cargo operation
    1. Goods vessels without cargo operation which have not called the ports of “Group A specified places” (High Risk) under the Prevention and Control of Disease (Regulation of Cross-Boundary Conveyances and Travellers) Regulation (Cap. 599H) during the 21 days prior to arrival in Hong Kong purely for shipping services (excluding ship repair)
  3. Government officials carrying out government duties

CHINA-HONG KONG BORDER SCHEUDLES TO REOPEN

Chief Executive Carrie Lam announced on 7th December 2021, there is a schedule to reopen China and Hong Kong border. The government is working to set quotas for business people in different sectors. And Hong Kong will prioritize quarantine-free travel for business people when its China border reopens. However, the actual schedule and the plan is not rolled out yet.

Border Control Points

Meanwhile, most of the border control points are closed. The Security Bureau will consider the usage of relevant border control points in deciding whether

  • to extend the opening hours, and
  • to reopen more points

Furthermore, the Security Bureau will use the existing Road-Based Land Crossing ports. While the Rail-Based ports are still suspending.

Hong Kong Health Code

With the Hong Kong Health Code set to open for registration on Friday. Lam also called on citizens not to register for it unless there is an urgent need.

Start on 9th December, Hong Kong people are compulsory to use LeaveHomeSafe app to record your visits. And the record had fulfilled the basic conditions to restart cross-border travel. Afterward, Hong Kong will introduce a mainland-style Hong Kong health code.

In the meantime, the Omicron variant has spread all over the world. However, Hong Kong takes an aggressive approach to ban the virus flowing into the community.  Thus, there is no effect on quarantine-free travel plan.
